2. Service description

Legend Smart provides digital educational content: structured self-development programs containing exercises in focus and attention, memory practice, creative thinking, problem solving and productivity habits. The service is delivered online. No physical goods are shipped.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract, to purchase a program.

4. Customer accounts

• You must provide accurate registration information and verify your email address.
• You are responsible for keeping your login credentials confidential.
• Accounts are personal and may not be shared or transferred.
• You must notify us promptly of any unauthorised use of your account.

5. Digital content and delivery

After successful payment, customers receive online access to the Legend Smart platform and the digital training program selected at checkout. Access is granted for the period stated on the program page and at checkout.

6. Pricing and payment

• Prices are displayed on the pricing and program pages in the selected currency.
• Listed prices in CAD and ZAR are set by Legend Smart and are not live exchange-rate conversions.
• Applicable taxes, where legally required, are calculated and displayed at checkout by our payment processor before you pay.
• Payments are processed by a third-party payment processor. We do not store raw card details.

7. Program duration and renewals

Programs are supplied as fixed-duration, one-time purchases. There is no automatic renewal and no recurring charge.

8. Customer responsibilities and acceptable use

• Use the content for your own personal, non-commercial development.
• Do not copy, resell, redistribute, publish or share program content.
• Do not attempt to gain unauthorised access to the platform or interfere with it.
• Do not use the service unlawfully or to harm others.

9. Intellectual property

All content, exercises, text, design and software on the platform are owned by or licensed to Legend Smart Ltd. You receive a limited, personal, non-transferable, non-exclusive licence to access the content during your access period.

10. Refunds

Refund requests may be submitted within 14 days of purchase, subject to applicable consumer law and the conditions of our Refund Policy, which forms part of these terms.

11. Cancellations

Cancellation terms are set out in our Cancellation Policy.

12. Service availability

We aim to keep the platform available at all times but do not guarantee uninterrupted access. Maintenance, updates or events outside our reasonable control may cause temporary interruptions.

13. Educational disclaimer

Legend Smart provides educational information and self-development exercises only. The service is not medical advice, psychological treatment, therapy or healthcare. No specific improvement in concentration, memory, intelligence, creativity, income, academic performance or professional performance is guaranteed. See our Disclaimer.

14. Limitation of liability

To the maximum extent permitted by law, our total liability arising from or in connection with the service is limited to the amount you paid for the program giving rise to the claim. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited.

15. Consumer rights

Nothing in these Terms is intended to exclude or limit any consumer rights that cannot lawfully be excluded under applicable law, including mandatory consumer protection rules that may apply where you live (for example in Canada or South Africa).

16. Changes to the service and to these terms

We may update program content and these terms. Material changes will be communicated by email or by notice on the platform. Changes do not apply retroactively to purchases already made where that would be unfair or unlawful.

17. Termination

We may suspend or terminate access if these terms are seriously or repeatedly breached. Where we terminate without cause, we will refund the unused portion of your access period.

18. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without depriving you of the protection of mandatory consumer law of your country of residence.
